IMHO, SCOTUS will rule that the procedure was unconstitutional but give the administration a period of time to correct how tariffs are constructed. This will require the White House to involve Congress, but likely won’t eliminate tariffs. I’m sure the administration has already more than stressed that the treasury needs that tariff money.

Even if SCOTUS said no, what's going to happen? The DOJ won't do anything, the republican congress won't do anything. Congress would be the ones to push the impeachment and need approval in both house and senate. It would be onto the corporations, but more likely us, the consumer, to refuse to pay the taxes somehow.

The recent meetings between China, Russia and India prove that our President's moves belong in the realm of security and foreign relations policy. Congress cannot deal with the details of these matters effectively and the judiciary should keep hands off unless executive actions very clearly violate the limits of executive power. Imagine if congress tried to authorize or restrict these kinds of executive actions and became frustrated by the senate's filibuster rules which then resulted in a significant set back in our national security.

In [the EO](https://public-inspection.federalregister.gov/2025-06063.pdf) Trump shotgunned a few different basis' for the tariffs.

The first justification in the EO, the International Emergency Economic Powers Act, don't provide the authority to impose the tariffs as far as I can tell. The [appeal ruling](https://www.cafc.uscourts.gov/opinions-orders/25-1812.OPINION.8-29-2025_2566151.pdf) discusses in brief the other parts of the executive order, but only affirms the 'IEEPA doesn't apply' opinion and doesn't rule anything about the 3 other cited sections of code and law that Trump called on in the EO. It also vacates the universal injunction and directs the lower court to apply a framework before imposing an injunction that confirms "that the public interest would not be disserved by a permanent injunction".

The court didn't determine that the EO was unconstitutional, or deem it illegal. They answered a question on appeal, which was whether the IEEPA allowed the tariffs - and it doesn't. If that were the only power cited in the EO, it would indeed be unconstitutional... But that's not the only power cited in the EO.

The EO calls on other powers, some of which do require investigations from either the US Trade Rep or the Sec of Commerce. And, the EO also cites a [memo](https://www.whitehouse.gov/articles/2025/02/reciprocal-trade-and-tariffs/) where those investigations were called for and states they were completed. Given that information, unless the courts can do some new crazy dance, I don't see a way all of the powers would be knocked out.

Which is probably why the appeals court directed the lower court to a framework for injunctions. This is going to get a bit spicy though, asking a lower court to rule on what public interest is on a move that's got particularly strong opinions on both sides of the issue. That inevitably politicizes the courts, when the powers are indeed granted and procedure has been followed to allow the EO.

Let me get this straight, we have had tariffs since DAY 1 of the Constitution but suddenly they are actually unConstitutional?

The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, 

IMPOSTS for anyone wanting to verify the word, do indeed COVER TARIFFS. While there can be some quibbling over congress vs president. It is clear that tariffs are CONSTITUTIONAL.

Won't matter. The appeals court stated that the legal route taken was illegal, but there are other legal routes so either those will be taken. Also, the supreme court will obviously side with him and if in some shocking turn of events they do not he will ignore them and they won't do anything about it. Time and time again he has shown that he will makes shit up and do his own thing and time and time again the powers that be do nothing about it because it suits their needs for the moment. Donald Trump used the tariffs to manipulate the markets for his own stock investment goals. When stocks were low enough, he bought low, then lowered the tariffs, and watched the stocks go back up so he could make a ton of money.

If you read the law or the constitution they are illegal.  The law says you need an emergency and Trump just makes up an emergency.  The constitution says only congress can imposed tariffs. None of that matters. The supreme court will once again bail Trump out and determine they are A OK.

I think this has to do with previous decisions that say lower courts can’t put up nationwide injunctions and being the president railing against judges. Judges are fearful of having their names / families / careers dragged through the mud all for the ego of this doof. If he stops them then the market goes into further chaos. So if he says they are illegal. Then stops them he has to deal with that then he knows it’s going to the Supreme Court anyways cause doof takes everything there because the way the new system is set up everything does and that’s the only check on power doof believes has any authority on him. He lets the Supreme Court finally rule and he just gets off with a weird tweet and goes about his day. And the Supreme Court can deal with the terrorization from doof.
